William J. Barabino, who is Burbine’s lawyer in the Middlesex case, said Tuesday that he is challenging the admissibility of the computer evidence. A hearing on a motion to suppress the evidence is scheduled for August....
Burbine was convicted of indecently assaulting a child in 1989. His wife, Marian Burbine, is currently charged with recklessly endangering children, and records show that she knew about his prior conviction and allegations that he sexually assaulted young boys in 2005 and 2009.
Prosecutors did not bring charges in either of those cases.
Marian Burbine is free on bail and has a pretrial conference slated for July, court records show.
