Woman Wins Case in New Hampshire

"Court says N.H. woman has right to film police

A federal appeals court has refused to dismiss a woman’s lawsuit against the Weare Police Department, saying she had a constitutional right to videotape a police officer during a traffic stop. The US Court of Appeals for the First Circuit says citizens may videotape police officers performing their duties unless an officer orders them to disperse or stop recording for legitimate safety reasons. In its unanimous ruling Friday, the court rejected arguments by Weare officers that they should be immune from liability, under a theory that allows government officials to make reasonable mistakes that do not violate clearly established constitutional rights or state laws. The ruling allows Carla Gericke of Lebanon to pursue her civil rights violation lawsuit and contends that Weare police charged her with illegal wiretapping in retaliation for her videotaping a 2010 traffic stop of an acquaintance in another car. She was not prosecuted on the charge (AP)."

NEXT DAY UPDATEThe public’s right to know

Not in Massachusetts:

"Chicopee woman charged with secretly recording arrest

Police have charged a Chicopee woman with unlawful wiretapping after accusing her of surreptitiously recording her arrest on disorderly charges. The Springfield Republican reported that police accused Karen Dziewit, 24, of drinking outside a building about 2 a.m. Sunday, yelling and disturbing residents, and refusing to quiet down. When Dziewit was about to be arrested, police said she activated the voice recording feature on her smartphone, hid it in her purse, and recorded her arrest. As police inventoried her belongings during booking, they found the phone with its recording feature on. Dziewit was charged with unlawful wiretapping, disorderly conduct and an open container violation. She is slated to be arraigned in Springfield District Court on Monday (AP)."

Yeah, ONLY the GOVERNMENT can do THAT!

The reason is so you won't record things like this:

"DA rules that deadly police shooting in Chicopee justified

Investigators determined that a state trooper who shot and killed a motorist in Chicopee last year was justified in using deadly force. Trooper Thiago Miranda shot Wayne Edwards, 23, of Springfield twice after pulling him over for speeding on Interstate 291 in August. The Hampden district attorney’s office said Edwards resisted arrest and struggled. The trooper opened fire after Edwards put his vehicle into drive and started to pull away with the trooper halfway out of the vehicle. The report said Miranda ‘‘feared he would be seriously injured or killed.’’

Yeah, whatever.

And if you are lucky enough to get into court:

"Trial begins for Maine man stripped of right to lawyer

The trial for a Maine man has started without a defense lawyer after a judge stripped the defendant of the right to counsel, saying he was abusive toward court-appointed lawyers. Joshua Nisbet gave a brief statement at the start of his robbery trial Monday. The Portland Press Herald reported that Nisbet may be the first criminal defendant in Maine forced to represent himself after being stripped of his constitutional right to an attorney. Nisbet has been in Cumberland County Jail for nearly three years since being charged with holding up a convenience store at knifepoint. Justice Thomas Warren ordered Nisbet to represent himself after he went through five lawyers, one of whom said Nisbet threatened him. Nisbet has objected to representing himself."

You no longer have rights in AmeriKa; what you have is the arbitrary good will of a lying, looting government that views itself as not only above the law, but the law. Period.
