"Obama's orders leave torture, indefinite detention intact
On Thursday, President Barack Obama issued executive orders mandating the closure of the Guantánamo Bay prison camp in a year’s time, requiring that Central Intelligence Agency (CIA) and military personnel follow the Army Field Manual’s prohibitions on torture, and closing secret CIA prisons overseas. While the media is portraying these orders as a repudiation of the detention and interrogation policies of the Bush administration, they actually change little. They essentially represent a public relations effort to refurbish the image of the United States abroad after years of torture and extralegal detentions and shield high-ranking American officials from potential criminal prosecution. The orders signed by Obama do not undo the Bush administration’s attacks on constitutional and international law. They do not challenge the supposed right of the president to unilaterally imprison any individual, without trial and without charges, by declaring him to be an “enemy combatant.” Nor do they end the procedure known as “extraordinary rendition,” by which the United States during the Bush years kidnapped alleged terrorists and shipped them to foreign countries or secret CIA prisons outside the US, where they were subjected to torture."

WASHINGTON - With a few strokes of his pen, President Obama charted a new path yesterday in the fight against terrorism, signing executive orders to close the Guantanamo Bay detention center within a year and to ban harsh interrogation tactics, such as waterboarding, that the Bush administration endorsed but that critics consider torture....
In remarks to State Department employees, Obama called on the Palestinian militant group Hamas to end its rocket attacks but declared that Israel must reopen its border with Gaza - an underlying factor in the recent flare-up in violence. The speech, which drew enthusiastic applause, capped Obama's second full day in office, one carefully orchestrated to underscore stark changes in foreign policy from his predecessor.
By moving to close the detention center at the Guantanamo naval base and by immediately banning so-called "enhanced interrogation techniques," Obama removed two controversial linchpins of Bush's "war against terror." Obama said he intends to emphasize the rule of law and vowed to restore America's moral standing abroad.
"The message we are sending around the world is that the United States intends to prosecute the ongoing struggle against violence and terrorism....

Critics of the reforms.... argued yesterday that some of the 245 detainees now at Guantanamo could pose clear threats to national security if released. Pentagon statistics show that of the hundreds of detainees that have been released from Guantanamo since it opened in early 2002, at least 61 have returned to terrorist activities....

Obama also banned the CIA from operating secret, overseas prisons where the Bush administration permitted harsh interrogation techniques. Although legal scholars and human rights specialists believe some of those techniques - such as subjecting prisoners to the sensation of drowning - constitute torture, Obama will review whether the CIA needs special authority beyond the 19 approved interrogation techniques in the Army Field Manual.

BEIRUT - The emergence of a former Guantanamo Bay detainee as the deputy leader of Al Qaeda's Yemeni branch has underscored the potential complications in carrying out the executive order that President Barack Obama signed yesterday that the detention center be shut down within a year.
The militant, Said Ali al-Shihri, is suspected of involvement in a deadly bombing of the US Embassy in Yemen's capital, Sana, in September. He was released to Saudi Arabia in 2007 and passed through a Saudi rehabilitation program for former jihadists before resurfacing with Al Qaeda in Yemen.

His status was announced in an Internet statement by the militant group and was confirmed by a US counterintelligence official.

WASHINGTON - A federal judge has decided to give the Obama administration time to weigh in on some of the legal cases brought by terror detainees held by the United States, and the Supreme Court has granted a delay in the case of an alleged terrorist sleeper agent.

US District Judge John Bates gave the new president and his Justice Department until February to tell him whether they want to change the government's position on the definition of "enemy combatant." Prisoners from US detention facilities at Guantanamo Bay in Cuba and Bagram Airfield in Afghanistan are challenging their detention as so-called enemy combatants in federal court.
"The new presidential administration may wish to review the government's current position regarding the appropriate definition of 'enemy combatant' to be used in these and other habeas cases," Bates said Thursday. The Obama administration has until Feb. 9 to weigh in on Guantanamo Bay cases and Feb. 20 on cases involving detainees at Bagram Airfield.

President Obama on Thursday issued several executive orders reining in secretive US counterterrorism policies and ending harsh interrogations. The Supreme Court also granted the administration a month's delay in the case of alleged Al Qaeda sleeper agent Ali al-Marri, the only person being held as an enemy combatant in the United States.
Obviously, the MSM doesn't want to delve into that case of an innocent man indefinitely imprisoned on U.S. soil.
In a related matter, a Saudi militant who was released from Guantanamo Bay after six years of confinement is now a top figure in the Yemeni branch of Al Qaeda, a US counterterrorism official confirmed yesterday. Said Ali al-Shihri was released in 2007 to the Saudi government for rehabilitation. He reemerged this week, identified by a militant-leaning website as a top deputy in "Al Qaeda in the Arabian Peninsula," a Yemeni offshoot of the terror group headed by Osama bin Laden.

The announcement from the militant site came the same day that Obama signed an executive order directing the closure of the jail at Guantanamo Bay within a year.

At least 18 former Guantanamo detainees have "returned to the fight" and another 43 are suspected of resuming terrorist activities, Pentagon spokesman Geoff Morrell said on Jan. 13.
