WASHINGTON - The Supreme Court refused yesterday to consider stopping the execution of Larry Ray Swearingen, a Texas death-row inmate who says newly uncovered evidence proves his innocence.
Swearingen’s lawyers had asked the high court to decide for the first time whether executing an innocent person constitutes cruel and unusual punishment under the Constitution.
Lower federal courts declined to intervene in Swearingen’s case in part because, as the law stands, even uncontested scientific proof of innocence is not a valid reason for a federal judge to stop an execution.

Attorney General Greg Abbott of Texas, who opposed Swearingen’s request for a Supreme Court hearing, said Swearingen’s new scientific testimony doesn’t outweigh a “mountain’’ of other evidence “that Swearingen is guilty of capital murder.’’
In other words, the state doesn't give a damn about the truth!

BEAUMONT, Texas - A man charged in the fatal shooting of a bystander outside a Texas courthouse, sparking a shootout with law enforcement and a brief hostage situation, was ordered held on $4 million bond Thursday. Bartholomew Granger, 41, was also accused of wounding three other people Wednesday, including his daughter, whom authorities said he ran over with a pickup truck as he tried to flee.
Granger, who was on trial at the Jefferson County Courthouse in Beaumont in a separate criminal case, is now charged with one count of murder.
The woman killed, Minnie Ray Seabolt, 79, of Deweyville, Texas, appeared to be an innocent bystander, Jefferson County Sheriff Mitch Woods said. Granger’s daughter was in critical condition Thursday, authorities said. His daughter’s mother and the third person injured were treated at the hospital and released.
Authorities said Granger was outside the courthouse awaiting the continuation of his criminal trial Wednesday when he grabbed a gun from his truck and opened fire. Seabolt was shot as she tried to run to the courthouse, while others dropped to the ground and law enforcement officers returned fire. “It was crazy,’’ said Beaumont Police Chief Jimmy Singletary. “He was shooting. Our guys were shooting.’’
Judge Larry Gist, whose office is across the street from the main courthouse building, said there was pandemonium as law enforcement flooded the scene.

DALLAS - A Texas doctor is accused of running a massive health fraud care scheme with thousands of fraudulent patients and intermediaries offering cash, food stamps, or free groceries, to bilk Medicare and Medicaid of nearly $375 million, authorities said yesterday.
The federal indictment unsealed yesterday charges Jacques Roy, a doctor who owned Medistat Group Associates in DeSoto, Texas, and six others in an alleged scheme to bill Medicare for home health services that were not properly billed, not medically necessary, or not done.
The scheme was the largest dollar amount by a single doctor uncovered by a task force on Medicare fraud, authorities said.
