For more than a year, the Suffolk district attorney’s office withheld information that could cast doubt on the guilt of the man convicted in the notorious 2005 Bourneside killings before finally turning documents over to his defense attorney last week.

Based on the new information, the lawyer representing Calvin Carnes, who was sentenced to life for killing four young men in a Dorchester basement, has asked the state’s high court for a new trial.

“We have to do better than to let a DA sit for months and months and not inform the defendant that there is strong exculpatory evidence that could suggest he was wrongly convicted,’’ said Ellen Zucker, who filed a new motion with the Supreme Judicial Court late on Friday....

In a statement, Suffolk District Attorney Daniel F. Conley said that his office had conducted a thorough investigation of the new information and had turned over all of the evidence and documentation gathered during that investigation “immediately and affirmatively’’ after determining that neither the prisoner nor his statements were credible.

“The allegations come from a self-serving informant with a documented history of seeking benefits for himself in exchange for unsubstantiated, incomplete, or outright false information,’’ Conley said. Conley’s office did not specify what benefits the inmate was allegedly seeking. There is no indication the inmate and Carnes knew each other, according to Zucker and prosecutors. The inmate, whose name was not released, is serving two life sentences for murder, with no chance of parole.

Several lawyers familiar with such cases said it makes sense that prosecutors would take some time to examine new evidence before revealing it to the defense, but a delay of a year and a half is unusually long.

Almost as if they DIDN'T WANT YOU KNOWING and hoped you would GO AWAY and FORGET ABOUT IT, huh?

“The prosecutor has a continuing duty to disclose exculpatory evidence to defense counsel as soon as possible,’’ said Robert Griffin, a Walpole defense attorney who served as a Suffolk prosecutor for 13 years.

So WHEN will this ABOVE-the-LAW FASCIST GOVERNMENT face a JUDGE in a COURTROOM, huh?

Randy Gioia, a Boston defense attorney, said a long delay can hurt the defense and its attempt to investigate new evidence.

“Memory fades and witnesses might be lost,’’ he said. “If you had the evidence earlier you could have found some witnesses to corroborate what the inmate was saying. Maybe now [Zucker] is not going to be able to do that.’’

Wasn't that the WHOLE POINT and MOTIVATION?

If it was just ONCE maybe I could understand but this crap happens ALL the TIME here in AmeriKa!!
