THE HAGUE — The International Criminal Court charged President Omar al Bashir of Sudan with three counts of genocide in Darfur yesterday, a move that will add to the diplomatic pressure on his regime.
The decision marked the first time the world’s first permanent war crimes tribunal has issued genocide charges....
Last year, judges issued a warrant against the president for crimes against humanity but refused to indict Bashir on the genocide charges sought by prosecutor Luis Moreno Ocampo. The prosecutor appealed, and four months ago an appellate court ruled that the lower court’s decision was legally wrong.
Prosecutors then refiled their case, and yesterday judges issued an arrest warrant charging Bashir with three counts of genocide: by killing, by causing mental and physical harm, and “by deliberately inflicting conditions of life calculated to bring about physical destruction.’’

In Washington, P.J. Crowley, State Department spokesman, urged Bashir to submit himself to the International Criminal Court to face the genocide charges.

Sudan’s government criticized the court’s action.

Bashir, who was reelected to a new five-year term earlier this year, refuses to recognize the court’s authority and has repeatedly said he will not turn himself in to stand trial.
He was charged in March 2009 with five counts of crimes against humanity and two of war crimes for allegedly orchestrating atrocities in Darfur.

The court has no police force of its own and relies on international cooperation to arrest suspects. Bashir has flown to friendly nations since his original arrest warrant was issued. He has curtailed his travel to other parts of the world, however, fearing he could be arrested in countries that are prepared to execute the court’s warrants.
