NEW YORK - Bernard Madoff's accountant, David Friehling, will not have to appear in court until May 18 as part of a criminal case in connection with the money manager's Ponzi scheme.
Friehling, who was arrested on securities fraud charges last month, was scheduled to appear yesterday in Manhattan federal court. The court appearance was postponed because his lawyer and prosecutors are discussing a possible "disposition," Assistant US Attorney Lisa Baroni said in a court filing. Such language is standard in postponement requests and doesn't necessarily mean Friehling is having plea talks with prosecutors.
Separately, prosecutors and Madoff lawyer Ira Sorkin agreed that they wouldn't publicly disclose materials given to Sorkin concerning the amount lost by investors or assets sought by the government through forfeiture and restitution, according to a court filing. A key factor at Madoff's June 16 sentencing will be a determination by the judge of the amount lost by investors.
Madoff pleaded guilty on March 12 to defrauding investors by using money from new ones to pay off old ones. He faces as much as 150 years in prison.
