The federal government has decided not to appeal to the Supreme Court a landmark verdict for four men framed by the FBI in a gangland slaying, meaning the plaintiffs will receive a damage judgment that totals $101.7 million, according to one of their lawyers.

US Solicitor General Elena Kagan let the deadline pass yesterday for the government to challenge the award before the high court, said Victor J. Garo, the lawyer for Joseph Salvati, who lives in the North End.
His 77-year-old client spent more than 29 years in prison as a result of his wrongful conviction.

Garo said Salvati will receive the $31 million he was awarded by US District Court Judge Nancy Gertner in 2007 plus more than $2 million in interest that accumulated since then.
Garo said he and the lawyers for the other plaintiffs went to Washington several weeks ago to urge Kagan’s office not to appeal. The Justice Department, which had refused to pay up, tried to persuade Kagan’s lawyers to continue the legal fight....

Gertner found that the FBI protected Barboza and Flemmi because both provided valuable information against the Mafia....

NEW YORK — Two New Jersey men who were bound for Somalia to join an Islamic extremist group and to kill American troops were arrested at Kennedy International Airport late Saturday, federal and local authorities announced yesterday.
The men, Mohamed Haoud Alessa, 20, and Carlos Eduardo Almonte, 24, were to join Al Shabaab, which claims ideological kinship with Al Qaeda and which was thought to have provided a haven to Al Qaeda operatives wanted for bombings of US embassies in Kenya and Tanzania.

NORTH BERGEN, N.J. — Two terrorism suspects arrested at an airport over the weekend ran afoul of school officials and law enforcement over the last several years, with one considered so disruptive that he was removed from school and taught privately with a security guard present....

Authorities say Alessa, 20, and Almonte, 24, tried to fly out of New York’s Kennedy Airport Saturday in hopes of getting terrorism training in Somalia.
Alessa, who was born in the United States, is the son of Palestinian immigrants. Almonte is a naturalized citizen who was born in the Dominican Republic. Both are Muslim.
The two made their first federal court appearance Monday in Newark, and both requested court-appointed attorneys.
Translation: There will be no defense.
Almonte was arrested about a year ago and charged with aggravated assault for allegedly hitting someone on the back of the head with a glass picture frame in his hometown of Elmwood Park. The charge was dismissed in the fall, according to court records.

In 2004, he was arrested for possession of a knife on school property, assault, and underage drinking; court records reflect that he was fined $500 for the drinking charge and the other charges were dismissed.

Alessa attended ninth grade at the Al-Huda School, a private Islamic school in Paterson, a city about 15 miles from Manhattan that is the heart of New Jersey’s Arab-American community.
