"Critics say Afghan law 'legalizes rape'; Karzai assailed for signing legislation" by Fisnik Abrashi, Associated Press | April 3, 2009

KABUL - A new Afghan law makes it legal for men to rape their wives, human rights groups and some Afghan lawmakers said yesterday, accusing President Hamid Karzai of signing the legislation to bolster his reelection prospects.

Critics worry the legislation undermines hard-won rights for women enacted after the fall of the Taliban's strict Islamist regime. The law - which some lawmakers say was never debated in Parliament - is intended to regulate family life inside Afghanistan's Shi'ite community, which makes up about 20 percent of this country of 30 million people. The law does not affect Afghan Sunnis.

One of the most controversial articles stipulates the wife "is bound to preen for her husband as and when he desires."

"As long as the husband is not traveling, he has the right to have sexual intercourse with his wife every fourth night," Article 132 of the law says. "Unless the wife is ill or has any kind of illness that intercourse could aggravate, the wife is bound to give a positive response to the sexual desires of her husband."

One provision also appears to protect the woman's right to sex inside marriage, saying the "man should not avoid having sexual relations with his wife longer than once every four months."

The law's critics say Karzai signed the legislation in the past month only for political gains several months before the country's presidential election. The United Nations Development Fund for Women, said the law "legalizes the rape of a wife by her husband."

"The law violates women's rights and human rights in numerous ways," a development fund statement said. The United States is "very concerned" about the law, said State Department spokesman Robert Wood. "We urge President Karzai to review the law's legal status to correct provisions of the law that limit or restrict women's rights."

Wood added that US Secretary of State Hillary Rodham Clinton had met with female Afghan lawmakers in The Hague and had assured them that "women's rights are going to be paramount in this administration's foreign policy, not an afterthought."

Defense Minister Peter MacKay of Canada said he will use this week's NATO summit to put "direct" pressure on his Afghan counterparts to abandon the legislation. The issue of women's rights is a continuous source of tension between the country's conservative establishment and more liberal members of society. The Taliban government that ruled Afghanistan from 1996 to 2001 banned women from appearing in public without a body-covering burqa.

The video of a 17-year-old girl being flogged publicly by the Taliban in Pakistan's Swat Valley has galvanized the nation, drawing protests from human rights groups, denunciations from the central government, and expressions of revulsion from Pakistanis. "For God's sake, please stop, stop it," the girl pleads as the whip falls. "I am dying."

A Taliban spokesman, Muslim Khan, defended the public lashing, saying the girl had engaged in immoral behavior, but he was not specific. "It happened two months ago, when we were at war with the government," he told reporters in Swat. But local people said the incident had taken place two weeks ago in the village of Kala Kalae.

President Asif Ali Zardari and Prime Minister Yousaf Raza Gillani condemned the flogging and pledged an investigation. The government's former information minister, Sherry Rehman, requested a special session of Parliament.

"Such brutalities . . . cannot be allowed to take place under the leadership of a democratic government," Rehman said in a statement. "We cannot leave our citizens at the mercy of militants who are murdering and maiming our people in the name of Islam."

Insurgents in the valley, 100 miles north of Islamabad, the capital, struck a truce in February with Pakistani authorities. It called for the Taliban to cease hostilities and the government to permit the establishment of Islamic courts.

Some Pakistani religious leaders defended the public whipping. "The flogging is Islamic, and the punishment is written in the holy Koran," Mufti Munibur Rehman, a leading Muslim scholar, said in a televised debate. "So how can we term it un-Islamic?"

The central government was not a party to the peace accord, but signaled its approval and pulled back army troops. With the Afghan insurgency intensifying, the United States began launching more drone strikes against Al Qaeda and Taliban militants on the Pakistani side of the border last year. Since then, more than 30 US strikes have killed about 350 people, including midlevel Al Qaeda members, according to reports from Pakistani officials, residents, and militants.

Pakistan calls the strikes violations of its sovereignty and says the civilian casualties they inevitably cause inflame anti-US sentiment, complicating its effort to fight militancy.

Baitullah Mehsud, a Pakistani Taliban leader, yesterday claimed responsibility for the shooting at an immigration center in Binghamton, N.Y., in which a gunman killed 13 people, saying it was revenge for the drone attacks.

QUETTA - At least 62 people suffocated in the back of a truck packed with illegal migrants, and dozens were rescued unconscious after police acting on a tip opened the vehicle yesterday near the Afghan border. ISLAMABAD — An American U.N. worker abducted more than two months ago turned up unharmed Saturday, lying alongside a road in western Pakistan with his hands and feet bound and pleading "Help me, help me," the man who found him said.

John Solecki was discovered Saturday evening abandoned in a village some 30 miles south of Quetta near the Afghan border after his captors called a local news agency to tell them where to look, officials said....

Solecki made no public comment. Police and U.N. officials declined to discuss what led to his release. U.N. officials who met with him reported that he was "tired but all right," U.N. spokeswoman Jennifer Pagonis said....

The release was a rare piece of good news amid intensifying violence here that has raised international alarm over the nuclear-armed country's stability. On Saturday, a suicide bomber attacked a paramilitary base in the capital, killing eight.

Solecki's abduction and the killing of his driver on Feb. 2 in Quetta raised concern that he was another victim in a spate of attacks on foreigners blamed on Islamist militants operating from strongholds along the Afghan frontier.

A previously unknown group, the Baluchistan Liberation United Front, had claimed responsibility for the abduction, threatening to behead him and issuing a grainy video on Feb. 13 of a blindfolded Solecki pleading for help.

But the group's name and demands indicated they were ethnic Baluch separatists who have been waging a long low-level insurgency in the impoverished but oil-rich southwest of Pakistan and have no record of taking or killing Western hostages.

The kidnappers had demanded the release of hundreds of people from alleged detention by Pakistani security agencies. President Asif Ali Zardari last week announced that the government had "traced" 200 people previously listed as missing and provincial leaders insist they are no longer holding any political prisoners.

U.N. Secretary-General Ban Ki-moon said he was grateful for the efforts to secure Solecki's release, citing Zardari and Afghan President Hamid Karzai. But Ban, who was in Paris, also pleaded for the release of another U.N. official, Robert Fowler, was still missing in Niger.

Kidnappers in December took Fowler, a Canadian diplomat who serves as Ban's special envoy for Niger, an aide and their driver. The driver was released unharmed almost two weeks ago.

Antonio Guterres, Ban's high commissioner for refugees, expressed relief and gratitude. He added: "UNHCR looks forward to continuing its humanitarian efforts in Pakistan."

The suicide bomber who attacked the base Saturday in Islamabad sneaked in after dark from a wooded area at the rear and detonated his explosives inside one of several large tents used as sleeping quarters.
