Some states are considering separate lawsuits — Virginia filed one yesterday — and still others may join the multistate suit. On March 8, The Boston Globe reported on these efforts to derail a national health care law....

The lawsuit contends that the bill violates the 10th Amendment, which says the federal government has no authority beyond the powers granted to it under the Constitution, by forcing the states to carry out its provisions but not reimbursing them for the costs. The lawsuit also says the states cannot afford the new law....

“A legal challenge by the states appears to be the only hope of protecting the American people from this unprecedented attack on our system of government,’’ said Attorney General Henry McMaster of South Carolina, who is also running for governor.

But Lawrence Friedman, a professor who teaches constitutional law at the New England School of Law in Boston, said before the suit was filed that it has little chance of success. He said he cannot imagine a scenario in which a judge would stop implementation of the health care bill.

Still, McCollum said he expects the US Supreme Court will eventually decide if the overhaul is constitutional. “This is not lawful,’’ he said. “It may have passed Congress, but there are three branches of government.’’

WASHINGTON — A flood of lawsuits from states seeking to block the health care law President Obama signed this week raises sharp questions about the power of the federal government to impose mandates on its citizens, but legal scholars disagree about how the cases will be decided if they are heard by the Supreme Court.

Analysts said there is no direct precedent for Congress requiring that individuals purchase a product such as health insurance, although some indirect cases are cited by advocates on both sides....

The question falls squarely on centuries-old constitutional debates about the reach of the federal government in state affairs. Legal scholars on the right contend requiring citizens to obtain health insurance is a case of excessive federal intrusion and should be overturned by the judicial branch, while liberal judicial experts say Washington’s power to require that Americans buy insurance is clearly permitted under commerce and taxation provisions in the constitution.

Attorneys general in 14 states have filed suit against the health care legislation on grounds that it is unconstitutional. While the claims vary, a chief argument is that there is nothing in the Constitution that allows the government to require individuals to purchase anything. Lawsuits are also likely to be filed by insurance companies and individuals....

Even before the broader constitutional conflicts are decided, the matter could get bogged down in tactical court battles for years.

There are many routes that legal challenges are likely to take, potentially stalling or preventing implementation of the law. Opponents of the legislation are hoping that a federal district judge can be persuaded to impose an injunction against the legislation until the matter is heard in court. Among the states filing lawsuits against the federal government is Virginia, where the legislature earlier this month approved a bill that exempts Virginians from a federal or state health insurance requirement. Governor Bob McDonnell, the recently elected Republican, held a public signing ceremony yesterday. Similar legislation has been filed in at least 32 states.

McDonnell called the federal legislation “an unprecedented federal mandate on individuals that we believe violates the US Constitution.’’

Proponents of the federal health bill note that the matter most likely to face a legal challenge — the mandate to buy insurance — will not go into effect until 2014. As a result, Obama administration lawyers are likely to argue that federal courts cannot block something that has not yet gone into effect.

On the question of such a requirement at the federal level, the nonpartisan Congressional Research Service examined the issue recently and said it is a “novel’’ concept that has yet to be decided by the Supreme Court.

Proponents of the health care mandate cite a 2005 ruling by the Supreme Court that they say provided the legal groundwork for the legislation. In that case, Gonzales v. Raich, the court said the commerce clause of the constitution gave Congress the right to ban the growing of marijuana, even if states allow its use on medicinal grounds.

Moreover, the legislation was designed to defeat the constitutional arguments of health care opponents by imposing a penalty in the form of a tax on those who do not buy insurance. The Constitution clearly and indisputably gives the federal government the power of taxation.

In addition to the argument against the mandate, the bill is also being fought on grounds that it undercuts states’ rights, that it fails to provide enough money to the states to pay for new benefits, and that it is an intrusion on the business practices of insurance companies.

The Obama administration yesterday continued to mount a defense of the legislation.

“We will vigorously defend the constitutionality of the health care statute along with any other claims or litigation,’’ Justice spokesman Tracy Schmaler said. “We are confident that the statute is constitutional and will prevail when we defend it in court.’’

This means we spend a lot on care that does not contribute to better care, and there is extraordinary room for cost control that does not reduce access to or quality of care. However, we often pursue cost control strategies that are not based on evidence, and are designed to limit political opposition from the health care industry, for which our high costs are its high income....

Yup, and EVERYBODY KNOWS IT and the officials and authorities all walk around the pile of shit as if they can't smell it.


To a large extent, our high spending is due to a fragmented system where providers deal with hundreds of different insurers, all with different rules. This drives up administrative costs in the system, and means we lack what other jurisdictions have to effectively control costs: the ability to budget the health care system and publicly plan the allocation of limited resources to the communities and areas of care that need them most. This is why only nations with uniform payment systems and an extraordinary level of public oversight have been able to “bend the cost curve’’ without hurting health outcomes.

Effective cost control has proven to be politically impossible, particularly in Massachusetts. However, another failed attempt at cost control is unaffordable for the state, our municipalities, businesses, and households....

Since then it has been criticized by abortion opponents who say it has no actual impact other than restating restrictions on abortion funding already in the law.

Then why are the pro-abortion people in an uproar?

Representative Bart Stupak of Michigan, the leader of the antiabortion bloc of Democrats, insisted that is not the case. Lawmakers supporting abortion rights did not object to the order because they said it made no difference.

Gee, and the issue was such a lightning rod in the special Senate election up here, what with Marty Coakley standing tall for a woman's right to choose, etc, etc, etc.

Oh, right, politics.

You know, if it didn't make a difference why all the wrangling, horse-trading, and deal-cutting?

Obama invited Stupak and other lawmakers to the Oval Office for the signing of the order but made no effort to draw attention to it, and no members of the media were allowed in the room....

Senate Democrats drove toward final passage of a second health care bill, drafted to supplement the first by sweetening benefits for seniors with high prescription drug costs and for lower- to middle-income families who cannot afford the cost of insurance....

By 56 to 43, the Senate rejected an amendment by Senator Charles Grassley, Republican of Iowa, to force Obama and others in the government to obtain insurance coverage through new purchasing exchanges the law will create in 2014, as members of Congress and some staff would. The White House said the move was unnecessary because the president would do so voluntarily, but it was unclear whether the day-old law permitted him to.

Because of a couple of minor procedural changes made in the Senate, the bill had to be sent back to the House, which passed it last night and sent it to Obama for his signature.

Before the 56-to-43 vote in their packed chamber, senators stood and held a moment of silence for the late Edward M. Kennedy, honoring the Massachusetts Democrat for his career-long fight for universal health care and displaying a rare moment of comity during an often-ugly legislative battle....

And he would have settled for this, huh?

Obama, beginning a series of road trips to sell the health care law to the public, sought to reassure a sympathetic Iowa audience yesterday that the law would improve their lives....

Why would they have to FORCE it through and REASSURE us if it was REALLY GOOD for us?

House Democrats, meanwhile, were sobered by the threats.

Capitol Police, concerned about the potential danger, scheduled a Web seminar for lawmakers, letting them know how to recognize threats and how to stay safe.

Representative Luis Gutierrez, Democrat of Illinois, said his staff for the first time felt they had to accompany him from the House chamber to his office for safety. Another member, who asked not to be named, received a call saying the lawmaker would return to the home district only “in a box.’’

WASHINGTON — The FBI is investigating threats against lawmakers stemming from intense opposition to the health care overhaul law.

House majority leader Steny Hoyer said more than 10 Democratic lawmakers have reported incidents. The FBI and Capitol Police, Hoyer said, have briefed lawmakers on how to handle perceived security threats.

The FBI’s Washington field office said in a statement that all threats and incidents directed against members of Congress are taken seriously and are being investigated.

Representative Louise Slaughter, the chairwoman of the House Rules Committee, reported that someone left her a voice mail threat that used the word “snipers.’’

And then he went and popped off a shot at a Repuglican?

In addition, she said, a brick was hurled through a window at her district office in Niagara Falls, N.Y.

Protests swirled around the Capitol during debate on the health care overhaul last weekend. Demonstrators hurled racial slurs at several black lawmakers, and a protester spat at a black lawmaker.

While not directly criticizing Republican lawmakers, Hoyer said: “Any show of appreciation for such actions encourages such action.’’

WASHINGTON — Primary care physicians already are in short supply in parts of the country, and the landmark health care overhaul will bring them millions more newly insured patients in the next few years.

Translation: You will be waiting EVEN LONGER for appointments and in the waiting room.

But you are GONNA LOVE IT, 'murka!

Recently published reports predict a shortfall of roughly 40,000 primary care doctors over the next decade, as physicians are increasingly drawn to the better pay, better hours, and higher profile of many other specialties.

Oh, it is ALL ABOUT the MONEY, i$ it?

Provisions in the new law are aimed at easing the strain, including bonus payments for certain physicians and expansion of community health centers, but a growing movement to change how primary care is delivered may do more to help with the influx, advocates say.

It is called RATIONING, readers!

The “medical home’’ approach would enhance access to care, with a doctor-led team of nurses, physician assistants, and disease educators working together. Such teams could see more people while giving extra attention to those who need it most....

Sounds good, but that is what RATIONING IS -- all at a costlier expense than single-payer plan, Amricans.

At least health insurance companies are getting high incomes out of the deal.

The Massachusetts Medical Society reported last fall that just over half of internists and 40 percent of family and general practitioners were not accepting new patients, an increase in recent years as the state implemented nearly universal coverage. Nationally, the big surge for primary care will not start until 2014, when the bulk of the 32 million uninsured starts coming online.

What do you mean I don't have insurance yet and I will be waiting for more years?

Oh, yeah, the American people are going to love hearing that as their Medicare is cut and fees rise.

That was when I knew passage was assured.

The federal program that provides Pell grants to millions of middle- and lower-income college students got a $36 billion shot in the arm from part of the health care reform bill that was signed by President Obama yesterday.

Sounds great, right?


The legislation includes a major overhaul of federally backed student loans. From now on, borrowers will go directly to the federal government for these loans, and not to banks or other lenders.

And who is the government going to borrow the money fro.... same banks, right?


Sell bonds so taxpayers must pay even more?


While this will have little effect on student borrowers, it will make college loans that parents take out for their children slightly cheaper and easier to get.

I guess every little bit helps.


The student loan changes were included in the health bill in part to help offset the cost of the health plan. Of the $61 billion the government expects to save by cutting subsidies to banks for student loans, $36 billion will go the Pell grants, and $25 billion will go to lowering the deficit.

Many schools have been preparing for the change to direct loans, after the credit crisis hit two years ago and made private lenders less willing to extend government-backed loans....

Yeah, those banks are really helping us all out.

Pell grants are generally available to families earning less than $60,000 a year. The additional funding will increase the maximum grant to $5,500 this year, and eventually to $5,975 by 2017.

THAT'S IT?!!!

The legislation also adds an annual cost-of-living increase that would take effect in 2013.

Banks got their bailout they didn't even need inside a week.

Bernie Pekala, director of student financial strategies at Boston College, said the Pell Grant news was positive for students. The program was running short of money, due to high demand, and the new funds will shore it up.

Wars always get plenty, notice that?

By cutting subsidies to banks and setting that money aside for Pell grants, Pekala said, “The savings will help many of the most needy students in the country.’’

As for student loans, the changes will take effect July 1, pending a vote by the Senate. To most students, the shift will be barely noticeable. They will only apply for government funds to cover their tuition, rather than to a list of banks....

From which the government will borrow the money at interest and that which you will have to pay back later in debt service as a taxpayer, kiddo.

The student loan world was rocked two years ago when the secondary market for the loans shut down amid the credit crisis. That meant lenders could no longer sell off their loans to raise money for new ones....

There simply MUST be a BETTER WAY!

C'mon, kids, get on the stick and learn something useful at school for once!

The health care bill President Obama signed yesterday will probably force thousands of Massachusetts residents who receive subsidized health insurance through the state’s insurance exchange to eventually write two checks each month to pay for their coverage, to comply with strict new rules for abortion coverage.

That will help balance the old checkbook, 'eh?

And wait a minute! Pro-abortion Democrats said it meant nothing!


Abortion must be covered by health plans sold through the Massachusetts Connector, and the state says it already goes through elaborate accounting maneuvers to ensure no federal money is used to pay for abortions, as required by a longtime federal law. But a provision in the health bill mandates additional steps, starting in 2014.

The new system will not only be inconvenient for consumers, abortion-rights advocates say, but could hinder access to abortions by causing insurers to pull out of the Connector or choose not to participate in exchanges being set up in other states.

But don't worry; DemocraPs tell me you are going to LOVE IT!

Insurers that cover abortions would have to comply with complex new audits to make sure they are following the rules.

WASHINGTON — Massachusetts will receive an estimated $7.7 billion in federal aid and tax credits over the next decade under the new health care overhaul President Obama signed yesterday, according to an analysis prepared by the House Energy and Commerce Committee.

That is over $2 billion more than was reported.

The sum includes $2.3 billion in extra federal Medicaid money — more than the $2 billion over 10 years previously projected. The new law includes an expansion of Medicaid, a program jointly funded by states and the federal government.

As they cut funds from it?

Because Massachusetts already has expanded Medicaid to a broader base of low-income people, it would have been short-changed under the new law, according to members of Congress and health policy specialists.

Yeah, instead it will be taxpayers from the rest of the nation that get shortchanged so this deal could be cut.

Congress tweaked the Medicaid formula so that “do-gooder states’’ like Massachusetts would be compensated.

Oh, I wonder which states in America are NOT "DO-GOODERS" according to lying looters of the U.S. Congress.

Taxpayers would share about $2.4 billion in federal tax credits to pay for health insurance premiums. The new law requires most Americans, starting in 2014, to have health insurance, and the tax credits will help some low- and middle-income families buy the coverage.

Won't be enough, but that is your problem, not theirs.

Further, senior citizens in Massachusetts would save $1.6 billion in medication costs as the “doughnut hole’’ in Medicare prescription drug coverage is closed. Currently, seniors must pay out of pocket for drug costs that are more than $2,830 and less than $6,440 a year.

Yeah, that $3,500 hole was left from the LAST TIME THEY tried to HELP YOU, America!!

The typical beneficiary will get a $250 rebate this year for the coverage gap and would save $700 in 2011 and $3,000 a year by 2020, according to Markey.

Republicans, meanwhile, warn that those same Massachusetts residents will face higher taxes and Medicare cuts as the law takes effect.

“Did they tell you how much Medicare will be cut for taxpayers? How many taxpayers will get hit with new taxes? How many will see their premiums go up? No? Weird,’’ said Don Stewart, a spokesman for Mitch McConnell of Kentucky, the Senate Republican leader....

Gunn was charged with obstruction of Congress.

Gunn administers Community Development Block Grants, or CDBGs, as part of a federal program meant to spur local economic development.

“Absolutely, it is’’ a “big government’’ program, Gunn acknowledged. But “if I lost my job because they didn’t have it any longer, I’d be fine with that,’’ he said.

Gunn said he hadn’t been involved in politics until George W. Bush initiated the bank bailout in 2008. President Obama’s election, the ensuing auto industry bailout, and the health care package aggravated Gunn’s anti-government ire.

“I was just lazy, dumb, and happy, sitting at home and letting things take care of themselves,’’ Gunn said....
