London Adjusts Law to Please Israel

"British law restricts libel suits" April 26, 2013

LONDON — London’s reputation as the libel capital of the world, ‘‘a town called sue,’’ is poised to end.

A law enacted Thursday strengthens the position of people sued for libel here and ends most cases of so-called libel tourism, the practice by which powerful foreigners — Russian oligarchs, Arab oil magnates, and large corporations, among others — have brought libel cases against authors, journalists, academics, scientists, and bloggers, often based on the most tenuous of connections to England.

Under the new law, claimants wanting to sue defendants who do not live in Europe will have to prove that England is the most appropriate place for the case.

The new law applies only to England and Wales; Scotland and Northern Ireland have different systems.

The law does not upend the basic premise of English libel cases, that the burden of proof rests with the person being sued, rather than the plaintiff. It strengthens a defendant’s position in a number of ways, however, making it harder for aggrieved parties to sue and easier for people to defend themselves.

For instance, people who sue will now have to prove that the speech at issue has caused, or is likely to cause, serious harm to their reputations. Corporations and other entities that sue will have to prove that they have incurred, or are likely to incur, serious financial loss.

GENEVA — A United Nations special investigator said Tuesday that his reputation is being smeared and that he will not resign, despite calls for his ouster over provocative remarks about terrorism, the United States, and Israeli policy.

Richard Falk, the UN special rapporteur on human rights in the Palestinian territories, said in Geneva that he is only doing his job, and ‘‘it’s important to distinguish criticism from this kind of smear campaign.’’

This is the guy who put out the report documenting Israeli use of WMD and war crimes during Operation Cast Lead. Israel has been gunning for him ever since, if not before.

In public remarks and reports sharply critical of Israeli settlement policy, Falk has repeatedly run afoul of advocacy groups such as UN Watch, which accuses him of anti-Semitism, and the United States, which called for his resignation. 

That BRUSH of TAR is really GETTING OLD, guys! Meeting LEGITIMATE CRITICISM with the SCREAM of anti-Semitism is really TURNING OFF the WORLD!

The Geneva-based UN Watch, which is affiliated with the more than century-old American Jewish Committee, has campaigned for the UN Human Rights Council to remove Falk from his position. Falk, in turn, has urged the council to investigate UN Watch’s self-appointed watchdog credentials.

They have some nerve after the U.N. imposed Israel on the Palestinians.

‘‘I don’t intend to resign, and there doesn’t seem to be any formal initiative that is seeking my dismissal,’’ said Falk, a Princeton University emeritus professor.

That's the best thing you can do now: ignore Israel and BDS.
