TAUNTON — When Daniel J. Ferreira was accused in 1999 of pulling his car up to two boys and asking for sex, the Rehoboth man allegedly said he targeted people who are smaller than him, so “I don’t get beaten up if they get mad,” according to a police report.

That's funny; the AmeriKan and Israeli governments do the same thing.

Fifteen years later, prosecutors say Ferreira, a Level 2 sex offender, is still zeroing in on children.

He stands accused of raping a 15-year-old boy he allegedly approached on Wednesday while driving in Rehoboth.

“The record is quite alarming to us,” Bristol Assistant District Attorney Jeffrey Daley said Friday in Taunton District Court.

Judge Gregory Phillips set bail at $50,000 after hearing allegations that Ferreira, 34, raped the boy after the teen rebuffed a request for oral sex while they were smoking marijuana in a wooded area.

That does it. No more pot, no medical, nothing.

Not-guilty pleas were entered on Ferreira’s behalf to charges of child rape and enticing a child under 16.

Defense attorney Colleen A. Tynan said the encounter was consensual and did not involve the use of force.

“He believed that the person was over the age 16 because he had been told that he was,” she said.

The case was reported to police Thursday after the teen spoke to a psychologist at Dighton-Rehoboth Regional High School, according to a police report filed in court.

The teen said he was walking on Providence Street on Wednesday at about 5 p.m. when he noticed a blue Honda Accord, allegedly driven by Ferreira, pass him three or four times, the report said.

The boy flagged down another car and told the driver about the Accord, Daley said.

After the car the boy flagged down left, Ferreira drove up again and the boy asked him what he wanted, the report said.

The boy asked Ferreira if he had any marijuana, the report said.

“They went into the woods right in that area and smoked some marijuana and had conversation,” said Daley.

That was when Ferreira asked the teen to engage in a sex act, the report said.

When the boy said no, Ferreira ignored his answer and sexually assaulted him, Daley said.

Ferreira told officers the sex was consensual, the police report said.

During his arraignment, Ferreira sought to hide from spectators by holding his hands to his face.

He is due back in court Oct. 9.

The latest allegations are similar to charges brought against Ferreira on accusations of enticing a child under 16 in 2004 and lewd, wanton, and lascivious conduct in 1999, court records show.

The 1999 case was continued without a finding, and Ferreira was expected to complete counseling, according to documents filed in court by Kenneth J. Pacheco, assistant chief probation officer.

The charges were dismissed on Dec. 7, 2001, the documents state.

Ferreira was charged three years later when police allege he waved over a boy riding an all-terrain vehicle in Rehoboth and asked him to engage in a sex act on Oct. 4, 2004, according to a police report filed in court.

The boy later told his mother what had happened, the report said.

Ferreira denied the boy’s account to police, but a judge found him guilty after a trial, court records show.

He was sentenced to serve 30 days of a 2½-year sentence, put on probation, and ordered to register as a sex offender, court records show.

While on probation for that and another case, Ferreira’s sex offender clinician concluded on Jan. 26, 2010, that he posed “a potential danger” to the community and was “resistant” to the objectives of his sex offender treatment program, court records show.

Tynan, the defense attorney, said Ferreira encountered some issues while on probation, but none resulted in more jail time.

Ferreira has also served jail time for “some other minor charges,” Daley said.

In 2008, Ferreira was charged with failing to register as a sex offender, but the charges were dismissed at the request of prosecutors, court records show.
