A federal appeals court yesterday for a second time rejected a lawsuit by Guantanamo Bay detainees who say they were tortured and denied religious rights. Four British men say they were beaten, shackled in painful stress positions, and threatened by dogs during their time at the US naval base in Cuba. They also say they were harassed while practicing their religion, including shaving their beards, banning or interrupting their prayers, denying them copies of the Koran and prayer mats, and throwing a copy of the Koran in a toilet.

The defendants in the case included top Bush administration military officials such as former secretary of defense Donald Rumsfeld. The Court of Appeals in Washington ruled against the detainees early last year, saying because the men were foreigners held outside the United States, they do not fall within the definition of a "person" protected by the act. But later in the year, the Supreme Court ruled that Guantanamo detainees have some rights under the Constitution and instructed the appeals court to reconsider the lawsuit in light of their decision.
Yesterday, the appeals court reached the same conclusion, noting that the four men who filed the suit - Shafiq Rasul, Asif Iqbal, Rhuhel Ahmed, and Jamal Al-Harith - were released in 2004, more than four years before the Supreme Court ruling....

WASHINGTON - President Obama declared yesterday that he would try to block the court-ordered release of photos showing US troops abusing prisoners, abruptly reversing his position out of concern the pictures would "further inflame anti-American opinion" and endanger American forces in Iraq and Afghanistan.
The White House had said last month it would not oppose an Appeals Court ruling that set a May 28 deadline for releasing dozens of photos from military investigations of alleged misconduct. But American commanders in the war zones have expressed deep concern about fresh damage the photos might do, especially as the United States tries to wind down the Iraq war and step up operations against the Taliban and Al Qaeda in Afghanistan.

When photos emerged in 2004 from the infamous US-run Abu Ghraib prison in Iraq, showing grinning American soldiers posing with detainees - some of the prisoners naked, some being held on leashes - the pictures caused a huge anti-American backlash around the globe, particularly in the Muslim world.
Obama, explaining his change of heart on releasing the other photos, said they had already served their purpose in investigations of "a small number of individuals." Those cases were all concluded by 2004, and the president said "the individuals who were involved have been identified, and appropriate actions have been taken."
That's called a COVER UP, folks!!
Military commanders' concerns were most intense with respect to Afghanistan. The release would coincide with the spring thaw that usually heralds the year's toughest fighting there - and as thousands of new US troops head into Afghanistan's volatile south.
I don't think torture photos from five years ago is gpoing to mean much in the middle of a HOT WAR, s***ter!!!!

The effort to keep the photos from becoming public represented a sharp reversal from Obama's repeated pledges for open government, and in particular from his promise to be forthcoming with information that courts have ruled should be publicly available....
At this point, I'd be surprised if he fulfilled one.
On Capitol Hill, Republicans welcomed the change, however. A military group also said it was relieved. "These photos represent isolated incidents where the offending servicemen and women have already been prosecuted," said Brian Wise, executive director of Military Families United. "There is no good that can come from releasing these photos."

Nevertheless, the Pentagon said yesterday that it still plans to follow the president's orders and shut down the Guantanamo prison by January as Obama has ordered. But Defense Department spokesman Geoff Morrell said that at least some funding needs to be passed now or else it would be "exceedingly difficult" to meet Obama's target date.
Why? They can FIND MONEY to KEEP OCCUPATIONS going so why would this be so difficult? BANKS get their $$$ RIGHT AWAY, too, so WTF!!!!!!??

WASHINGTON - The Supreme Court yesterday overturned a longstanding ruling that stopped police from initiating questions unless a defendant's lawyer was present, a move that will make it easier for prosecutors to interrogate suspects.
The high court, in a 5-to-4 decision, overturned the 1986 Michigan v. Jackson ruling, which said police may not initiate questioning of a defendant who has a lawyer or has asked for one unless the lawyer is present....
So much for the Constitution.
Justice John Paul Stevens said:
"The police interrogation in this case clearly violated petitioner's Sixth Amendment right to counsel." Overruling the Jackson case, he said, "can only diminish the public's confidence in the reliability and fairness of our system of justice."
The Obama administration had asked the court to overturn Michigan v. Jackson, disappointing civil rights and civil liberties groups that expected President Obama to reverse the policies of his Republican predecessor, George W. Bush....

Three national evaluations found that the program is not effective, according to a budget document released by the administration, which estimates $66 million would be saved by cutting the program.

LONDON (Reuters) - Photographs of Iraqi prisoner abuse which U.S. President Barack Obama does not want released include images of apparent rape and sexual abuse, Britain's Daily Telegraph newspaper reported on Thursday.
The images are among photographs included in a 2004 report into prisoner abuse at Abu Ghraib prison conducted by U.S. Major General Antonio Taguba. Taguba included allegations of rape and sexual abuse in his report, and on Wednesday he confirmed to the Daily Telegraph that images supporting those allegations were also in the file.
"These pictures show torture, abuse, rape and every indecency," Taguba, who retired in January 2007, was quoted as saying in the paper..... The newspaper said at least one picture showed an American soldier apparently raping a female prisoner while another is said to show a male translator raping a male detainee.
