"State listed as 41st in fighting tobacco use

Massachusetts
has fallen six places to rank 41st nationally in funding programs to prevent children from smoking and to help smokers quit, according to a new report.

You mean we are NOT number one AGAIN?

The coalition of public health organizations that released the report yesterday said nearly 18 percent of state high school students smoke. About 6,300 children become regular smokers every year as tobacco takes 9,000 lives and costs the state $3.5 billion in health care bills.

But it's a legal product.


But Massachusetts has cut state funding for tobacco prevention by 63 percent, from $12.2 million to $4.5 million. (AP)

"Appeal seeks new trial over ‘CSI’ remark

A man convicted of killing three of his girlfriend’s four children is asking for a new trial, contending that the judge degraded his defense by telling jurors, “This is real life and not ‘CSI.’ ’’ Vuthy Seng of Lowell was convicted of shooting and attacking the children with a machete in 1995 after their mother asked him to move out of their apartment.

Seng argues that the judge’s reference to the popular television crime drama belittled his defense, which asserted that the investigation was deficient because police failed to perform certain scientific tests. "Burglars get $4,000 in electronic gear

Police officers on Cape Cod are investigating a break-in at one of their own facilities. Authorities said two 42-inch flat screen televisions, two Xbox game systems, a Wii game system, and six video games were stolen from a building housing the Police Athletic League in Falmouth. The stolen items had a total value of nearly $4,000. Police also said that a $10,000 theater system and four doors were damaged in the break-in. (AP)

"Man sentenced for running down a duck

A Massachusetts man has been sentenced to a year of probation for running over and killing a mother duck walking her 12 ducklings across a parking lot.

THAT'S ALL!!??

He KILLED an INNOCENT LIVING CREATURE and a MOTHER of TWELVE!!!!!

"Driver pleads not guilty to animal cruelty

A Massachusetts man has pleaded not guilty to a charge of animal cruelty after authorities said he ran over a mother duck as she was walking with 12 ducklings in a shopping mall parking lot last month. The driver, Joshua Linhares, 25, of Acushnet, was released on personal recognizance following his arraignment yesterday.

Jim Sheerin, first assistant clerk for New Bedford District Court, said Linhares’s case was continued to Sept. 25 for a pretrial hearing. Linhares told police that he did not see the ducks at Dartmouth Mall and that he left the scene because witnesses were laughing at him (AP)."

"Acushnet man charged with killing duck released on personal recognizance

Police and witness statements who say Linhares laughed and sped away seconds after he ran over the duck.... A woman who was stopped at the intersection near where the incident occurred said Linhares smiled at her, then sharply turned his vehicle and sped directly at the ducks.... As Linhares drove by after the incident, the woman said he smiled and laughed. He left the parking lot, even though witnesses were yelling at him to stop....

A store surveillance video, which appeared to corroborate the witness statements that Linhares smiled and laughed as he drove off....

I'm to the point now where he also gets the sliding blade.


After the incident, the security officer walked outside to the parking lot and gathered the 12 ducklings and their dead mother into a box.

I'm having a hard time keeping a grip on myself right now.

I know they are "only" animals and not people, but do you not think they feel pain?

Can't sense their mommy is dead?


According to Dartmouth Animal Control, the mother mallard had been nestling for at least five years in a retention pond behind BJ's and Home Depot at the Dartmouth Town Center. Every spring, traffic on Faunce Corner Road would halt as the mother led her ducklings down the ramp from Sears and across the road to the Paskamansett River.

"MSPCA sees a rise in abandoned cats

Seven cats were abandoned in eight days near the MSPCA headquarters in Jamaica Plain, including one left in a taped-shut box 100 yards from the building during Saturday’s snowstorm. “A lot of people are surrendering pets now due to the economy,’’ said Brian Adams, spokesman for the Massachusetts Society for Prevention of Cruelty to Animals. The center requests a $50 donation from those surrendering animals.

Man cited for crash while on cellphone

A 31-year-old South Boston man has been cited for crashing into a parked car while he argued with his girlfriend on a cellphone, Boston police said. Brendan Klaes was issued a citation for unsafe passing and impeded operation of a motor vehicle due to the use of his cellphone. Police said Klaes attempted to pass a city bus that was picking up passengers Monday but lost control and struck a parked car. Klaes told officers he was on his cellphone arguing with his girlfriend when he tried to pass the bus.

Police search for missing autistic teenager

Boston police are searching for an autistic teenager who went missing on Tuesday. Jeffrey Cooper (above), 14, of Boston was last seen going to an after-school program in Central Square in Cambridge. He was reported missing at around 2:50 p.m. Police said that his autism makes it difficult for him to communicate and that he has wandered away before.

Just wondering how a kid could be a gregarious partyer and hacking computer whiz and still have
autism.

Cooper was last seen wearing glasses, a black winter coat, black sneakers, and a green and white Celtics hat. He enjoys riding trains and might try to visit the South End area or the Boston Public Garden. Police are seeking public assistance in locating Cooper.

Do the police ever prevent or solve anything in Boston?

"Mercury spills in Cape Cod kindergarten

TRURO, Mass. --Kindergarten and preschool classes at a Cape Cod school have been canceled until next week while a mercury spill is cleaned up. The accident occurred on Monday in a kindergarten play area at Truro Central School. School officials say a child picked up an old blood pressure gauge and it broke while she was holding it, causing beads of mercury to spill out.

"Drug Sweep nets 16 allegedly in gang

Sixteen suspected members or associates of street gangs operating in Fitchburg were arrested yesterday in a joint federal and state investigation of drug trafficking in the city, US Attorney Carmen M. Ortiz announced. Eight people were arrested on federal gun and drug charges. Eight additional arrests were made for similar state charges. Ortiz said the 16 are members or associates of two gangs, the Latin Kings and the Bloods.

"Green Line train derails at Copley Station

A Green Line trolley traveling westbound derailed at Copley Station yesterday afternoon, fire officials said. The subway line was closed for several hours while officials investigated and removed the train. About 90 people were on the train at the time, but no injuries were reported. Fire officials said the train, coming from Arlington Station, was traveling very slowly when it came off the track. The derailment sparked a small trash fire, but it was quickly stomped out. The MBTA bused passengers around the area of the accident yesterday, causing minor delays.

Officials seek source of harbor spill

The Coast Guard is investigating the source of a spill yesterday of about 50 gallons of a fuel-like substance that now covers most of the Fairhaven side of New Bedford’s inner harbor, Petty Officer Connie Terrell said. The source is unknown, she said. The substance cannot be extracted from the water, so it will have to clear away on its own, Terrell said. The Coast Guard is unsure how long that will take, but yesterday’s rain and wind were speeding dissipation of the spill.

"2-year-old found sleeping in hallway

A naked 2-year-old boy was found sleeping in the hallway of a Dorchester apartment building yesterday, using his diaper as a pillow, Boston police said in a statement. A resident notified police, who found the child at about 2 a.m. in a common hallway on the second floor, surrounded by feces and vomit.

There are WAY TOO MANY of THESE STORIES out there, folks!

Emergency medical workers transported the boy to Carney Hospital for treatment and evaluation. Officers found the boy’s father in one of the apartments in the Hancock Street building. He told officers his son “probably left the apartment after I fell asleep.’’ Elsewhere, an 11-year-old boy called police around 3:20 a.m. after he could not find his mother when he woke up in his Tonawanda Street home. Officers located the boy’s grandfather and left the boy with him. Police filed reports in both incidents that were forwarded to the Department of Children and Families. Detectives will conduct follow-up investigations, police said.

Man charged after rampage in hotel lobby

A Boston man knocked over several Christmas trees and broke a few desk lamps in the lobby of the Park Plaza Hotel early yesterday, according to police. Dan Calcut, 37, of Boston, entered the hotel at 64 Arlington St. around 2:14 a.m. Hotel employees told police that Calcut proceeded to kick and knock over the 10-foot-tall trees and break the lamps, while unleashing a string of profanity, the statement said. Hotel security officers were eventually able to slow the destruction, and police apprehended Calcut when they arrived, police spokesman James Kenneally said. Calcut was charged with malicious and willful destruction of property.

What was his problem?


Former Council leader Tierney dies at 68

Joseph M. Tierney, a longtime City Council president who ran for mayor in 1987, died in his home yesterday. Tierney, who was 68, died surrounded by family after a brief illness, according to an official at the Carroll-Thomas Funeral Home in Hyde Park. Tierney grew up in a South Boston public housing project. He became a city councilor in 1972 and served five terms as president. He resigned as councilor at large to take on Raymond Flynn in the 1987. Tierney lost in a landslide. He leaves his wife, Pat.

And he only gets a BRIEF?


"Man shot in chest on Newhall Avenue

A man suffered a gunshot to the chest at a residence on Newhall Avenue around 9:30 last night, but police could provide few details. Saugus Police Chief Domenic J. DiMella said he could not identify the victim, who was taken to Massachusetts General Hospital in serious condition. DiMella said he had no information on a suspect in the shooting.

Again, they know nothing, and this in a state with the strictest gun-control laws in the nation. Failing, I'd say.


"Resident charged with rape of girl, 3

A Kingston man was arrested yesterday, accused of raping a 3-year-old girl.

Joseph Gardner, 26, was being held on $1 million cash bail at the Plymouth County House of Correction after family members came forward. According to a statement released by the Kingston Police Department, the rape occurred Friday night. Police were notified Saturday and investigated the allegation, making the arrest yesterday morning. Police said Gardner has a prior criminal record. He will be arraigned today in Plymouth District Court.

Start culling the perverts, war criminals, and looters. Let God sort 'em out. I've heard it so many times about Muslims.


46 injured in icy 50-car pileup

Police say at least 50 cars crashed in a chain-reaction collision on a wet Connecticut road that was turning icy, and 46 people reported minor injuries. Shelton police Detective Sergeant Kevin Ahern said six people were taken to hospitals from the wreck, which happened shortly after noon yesterday on state Route 110. None of the injuries were life-threatening. (AP)

An off-duty Milton firefighter was shot and critically injured late Saturday night or early yesterday in what police described as an apparent episode of road rage on the streets of Quincy.

Joseph Fasano, 30, who has worked for the Milton Fire Department for the past four years, was driving near his home when the driver of a sports car in front of him repeatedly slammed on his brakes, forcing Fasano to slow down, police said. Both cars pulled over on Commander Shea Boulevard near the North Quincy Red Line Station. The drivers exchanged words, police said, and the other driver pulled out a .45-caliber handgun and shot Fasano in the abdomen.

Fasano was rushed to Boston Medical Center with life-threatening injuries. Police said yesterday that Fasano’s condition was critical, but the hospital would not comment on his condition....

Quincy police said Fasano’s girlfriend was in the car, witnessed the shooting, and called 911 on her cellphone, telling police that the suspect was a white man who fled in a gray or silver sports car. The suspect remains at large. Police were investigating last night. People with information about the shooting were asked to call the Quincy police.

How come they ALWAYS NEED YOUR HELP?

"UConn murder suspect due back in court

ROCKVILLE, Conn. --Prosecutors are expected to outline their case against a Bloomfield man accused of killing University of Connecticut football player Jasper Howard.

It's DEATH in one brief after another, isn't it?

A probably cause hearing is scheduled for Thursday in the murder case against John Lomax III.

Prosecutors say he was involved in a minor altercation with others outside a university sanctioned dance early Oct. 18. They say he and another man went back to Lomax's car and returned with knives. Prosecutors say several witnesses identified Lomax as the person who stabbed 20-year-old Howard of Miami. Lomax's lawyer has questioned the accuracy of those statements. Lomax, who faces charges of murder and conspiracy to commit assault, is currently being held in lieu of $2 million bond.

"Moose struck, killed, on Route 2 in Gardner

GARDNER, Mass. --State police say an 800-pound moose was killed after being struck by a vehicle on Route 2 westbound in Gardner.

That is not all that far from here, readers! Poor moose!!

Police tell The Telegram & Gazette that a Jeep Grand Cherokee struck the animal at about 5:45 p.m. on Sunday. The vehicle was totaled, but the driver, identified by police as by Alan Hunt Jr. of Turners Falls, was unhurt.

Poor vehicle!

Police think it was the same moose that was reportedly struck about an hour earlier in the eastbound lanes by a different vehicle. The driver of that car called police to say he had struck the animal, but did not stop because he feared the moose would attack him....

Oh, the MOOSE MUST have been TERRIFIED with all that HORSEPOWER around him!!!

"Police investigate alleged attack on couple

Boston police are investigating an attack early yesterday by two men wearing Marine uniforms, who allegedly told a woman walking downtown with her boyfriend that she should “drop that zero for a hero’’ before punching, kicking, and hitting him with a beer bottle. Police said they were called to Milk Street for a report of assault and battery at 12:34 a.m. The man, who sustained a head laceration and a compound fracture of the left ankle, and his girlfriend told police they were walking down High Street when they were approached by a group including the two men in Marine uniforms, police said. Words were exchanged and the other Marine punched the victim in the face, police said. One of the men said, “We’re Marines, we’ll kill you,’’ and struck the man in the head with a beer bottle, police said. Police are asking anyone with information about the incident to contact the Boston police downtown detective unit at 617-343-4248."
