A Quiet War Crimes Debate

"Goldstone defends UN report on Gaza; At Brandeis, jurist debates ex-Israeli envoy" by James F. Smith, Globe Staff | November 6, 2009

WALTHAM - International jurist Richard Goldstone offered a spirited defense last night of his bitterly disputed United Nations report on Israel’s invasion of Gaza, reminding a Brandeis University audience that it was the first such UN report to accuse Palestinian fighters as well as Israeli forces of committing war crimes.

But Goldstone faced an equally spirited rebuttal from former Israeli diplomat Dore Gold, who called the report “the most serious and vicious indictment of the state of Israel bearing the seal of the United Nations’’ since an infamous resolution equating Zionism with racism in 1975. Gold said the Goldstone report all but ignored Israel’s right to defend itself despite years of Palestinian rocket attacks and suicide bombings.

The Brandeis event marked the first time Goldstone has shared a forum with an Israeli since his four-member commission issued its report in September, to a storm of controversy. The Israeli government refused to cooperate with Goldstone’s team and has scorned the report as biased against Israel in its original mandate and prejudiced in its findings.

Hundreds of students, faculty, and prominent members of Boston’s Jewish community packed a hall in the student center to hear Goldstone and Gold. Security was tight, with police from Waltham and neighboring Newton joining campus police. But the atmosphere stayed civil outside the hall amid rival leafleters, and inside the hall there were polite bursts of applause for each speaker. Several students with placards taped to their backs stood up in protest at one point during Gold’s remarks, but a mild rebuke from Brandeis professor and moderator Ilan Troen, head of the Schusterman Center for Israel Studies, prompted them to sit down.

Goldstone said the forum allowed him a chance to explain the substance of his findings “and avoid the personal and ad hominem attacks that have marked the debate on the report to date.’’ Goldstone, a former South African constitutional court justice who is himself a Jew, said much of the criticism of the report was based on false premises.

For example, he pointed out that many complaints say the UN Human Rights Council’s mandate to Goldstone was biased because it called only for an investigation of illegal Israeli acts. But Goldstone said he had refused to accept that mandate precisely because of its bias, and he had agreed to take part only when he was given the chance to rewrite the terms of the investigation.

He said the revised language called for a probe into the conduct by both sides in the three-week war, which raged from late December last year to mid-January and took 13 Israeli lives and those of more than 1,300 Palestinians.

Actually, it was MORE than 1,400, but who is counting, right, MSM?

And the 10-to-1 ratio in dead TELLS YOU WHO were the AGGRESSORS!

Btw, 14 more Gazans are being added to the toll everyday -- not including any military actions by Israel!

Goldstone said his central criticism of Israel is that its strategy intentionally applied disproportionate force in Gaza to inflict widespread damage on the civilian population. His report found that the Israeli air and ground attacks destroyed 5,000 homes; put 200 factories out of operation, including the only flour factory in the country; systematically destroyed egg-producing chicken farms; and bombed sewage and water systems. “If that isn’t collective punishment, what is?’’ Goldstone asked.

And NO MENTION of the WMD USE, huh?

Goldstone said the days he spent in Gaza were full of surprises. He admitted to a bout of nerves at the thought of a Jew roaming around Gaza and said that just before he went he had a nightmare that he had been kidnapped by radicals “and that people in Israel were rejoicing,’’ drawing a laugh from the audience. But in the end, he said, he was struck by how similar Israelis and Palestinians were in their warmth and their aspirations. Goldstone has a long association with Brandeis and is board chairman of the International Center for Ethics, Justice and Public Life, which cosponsored the forum....

And if HE is taking heat from the Zionists do you think they even care what the goyim think?

Gold - who has three degrees from Columbia University, including a doctorate, and now runs the Jerusalem Center for Public Affairs - answered....

That's right, readers, it didn't even make my Slow Saturday or the Sunday Globe (when he usually has a column).

TO BRANDEIS University last night, South African jurist Richard Goldstone brought his international reputation as a legal scholar, a human rights advocate, and the former chief prosecutor of the United Nations tribunals for the former Yugoslavia and Rwanda. Dore Gold, Israel’s former ambassador to the UN, brought facts and figures, maps and photographs, and audio and video in English, Arabic, and Hebrew.

The two men were at Brandeis to discuss Goldstone’s highly controversial UN report on Operation Cast Lead, the Israeli attack in Gaza last winter. The report, written after a fact-finding mission with which Israel refused to cooperate, accuses the Jewish state of committing war crimes by using “disproportionate force’’ to inflict widespread destruction on Palestinian civilians - a policy that amounted to “collective punishment on the people of the Gaza Strip.’’ Last night’s encounter marked the first time since the report was issued that Goldstone publicly debated the report’s merits with a leading Israeli figure. It would not surprise me to learn that he is in no hurry for a second.

That is not to say that Goldstone didn’t speak well, even eloquently, in defending his own integrity and his chagrin at Israel’s refusal to have anything to do with his commission’s inquiry. Nor was there any mistaking his sincere outrage when he itemized the physical devastation he viewed in Gaza - 5,000 homes destroyed, 200 factories disabled, water systems wrecked, poultry farms demolished - or when he denounced the bombing of a mosque during prayers. “If that isn’t collective punishment, what is?’’ Goldstone asked. Such attacks, he said, “scream out’’ for investigation by Israel.

But Goldstone spent much of the time talking about himself - he recounted his dealings with the chairman of the UN Human Rights Council, his nightmares about being kidnapped by Hamas, his pleased discovery that ordinary Palestinians were “just like’’ ordinary Israelis - while his interlocutor focused relentlessly on facts and evidence.

Yeah, attack his personality and claim the lying Zionist opponent told the truth.

Gold played video of Israelis under Hamas rocket attack, and noted that such attacks had increased 500 percent after Israel’s withdrawal from the Gaza Strip.

You SAW the GRAPH ABOVE so you KNOW IT'S a LIE!!!

He displayed aerial photographs of Hamas military installations located amid schools and mosques. He described Israel’s extraordinary efforts to avoid civilian casualties, and showed Palestinian TV broadcasts confirming those efforts. He presented images of weapons caches inside Palestinian mosques and homes.

Yeah, you can TOSS OUT any information Israel gives you because THEY LIE!!!!!!!

It was a powerful presentation - so powerful, in fact, that Goldstone regretted not having seen it earlier. “The sort of information shown to us by Ambassador Gold,’’ he said, “should have been shown to us during the [UN] investigation.’’

Which begs the question WHY DIDN'T the ISRAELIS TURN IT OVER TO HIM? If they are SO WORRIED about BIAS in the report!!??

Yet to my mind, what was most striking of all was Goldstone’s inability to give a clear answer to an essential question: What should a law-abiding country do to defend itself against relentless terrorist attacks?

In one form or another, that question came up repeatedly. In his welcoming remarks, Brandeis president Jehuda Reinharz observed that we live in a “new age of warfare,’’ in which civilized nations confront terrorists able to “mix and melt’’ into the civilian population. Asked Gold, after describing the thousands of rockets launched by Hamas at Israeli communities: “What would you do if your population was facing repeated attacks for eight years?’’ During the question-and-answer period, a student asked Goldstone - who had condemned Israel’s “disproportionate’’ attacks - what he would have considered a “proportionate’’ response.

But the judge, astonishingly, had no answer. He responded that that was a decision for the Israelis to make. He said it was a question that had given him “many sleepless nights.’’ He mused that perhaps undercover “commando attacks’’ would have been more appropriate. (“Gee, why didn’t the Israelis think of that?’’ murmured a voice in the audience.) He even suggested that it might make a good subject for a Brandeis research paper.

Judge Goldstone uses his international platform to pronounce Israel guilty, in other words, but will not say how Israel could have avoided such a verdict.

For the truth is, no other verdict was possible. Where the UN is involved, the guilt of the Jewish state is always taken for granted.

How many U.N RESOLUTIONS has ISRAEL DEFIED with NO RAMIFICATIONS or REPERCUSSIONS? And this puke speaks of BIAS?

Was ISRAEL INVADED like IRAQ, who DIDN'T EVEN VIOLATE U.N. RESOLUTIONS? There was NO WMD THERE!!!

The eminence of its chairman notwithstanding, the Goldstone Commission was a sham, and its bottom line was foreordained.

So was the 9/11 Commission, bozo!

The mystery isn’t why the Goldstone Report has been so widely denounced, but why Goldstone agreed to write it in the first place.
