One day after Bernard L. Madoff pleaded guilty to running the biggest Ponzi scheme in history, his attorneys yesterday appealed the judge's order that sent the disgraced financier to jail.

US District Judge Denny Chin in New York revoked Madoff's $10 million bail on Thursday, after Madoff, 70, pleaded guilty to 11 charges of fraud. Chin ruled Madoff was a flight risk because of his age and enormous wealth.

But in court documents filed yesterday, defense lawyers argued there was no reason to jail Madoff while he awaits sentencing, because he has not attempted to flee since his Dec. 11 arrest and his circumstances did not change with his guilty plea.

Madoff was already resigned to "the fact that he would die in prison," the lawyers wrote in documents filed with the 2d US Circuit Court of Appeals....

Then WHY doesn't he just STAY THERE, asshole!!!!!

According to documents filed in court yesterday, Madoff and his wife had a net worth of between $823 million and $826 million at the end of 2008.

According to the filing, their assets included four properties worth $22 million from Palm Beach to New York to the French Riviera, including $7 million for a Manhattan penthouse alone. They also had $17 million in cash, a share of a charter airplane worth $12 million, a $7 million yacht, $2.6 million in jewelry, a $2.2 million fishing boat, $65,000 in silverware, and a $39,000 piano.

Jeffrey Sonn, a securities fraud lawyer who represents dozens of Madoff victims, said many clients were outraged the financier was allowed to remain inside his luxury apartment until Thursday.

"They are glad he is sitting in an 8-foot-by-7-foot cell," said Sonn of Sonn & Erez in Fort Lauderdale. "I want to turn his apartment into a Ronald McDonald House for victims so they have a place to stay" when they are in New York for Madoff-related court hearings....

Roger Marino, the cofounder of data storage company EMC in Hopkinton, who lost money with Madoff, said the fraud was particularly cruel because it not only harmed wealthy investors, but also countless small charities. Marino said he personally has been forced to cut back on donations because of his losses with Madoff.

"He hurt a lot of small, needy people," Marino said. "I think he should never see the light of day again."

Actually, neither should EMC, the frikkin' hypocrites!

Still, Saphira Linden, artistic director at the Omega Theater in Jamaica Plain, which lost its entire $70,000 endowment with Madoff, said she thought it was more important to persuade Madoff to cooperate with investigators than to send him to jail.

"It doesn't do anyone any good to have him in jail, except for revenge," Linden said. "What is important is to find the money that is hidden."
