NEW YORK - As an alleged Al Qaeda operative pleaded not guilty yesterday to plotting a bomb attack in New York, the city’s police commissioner pronounced the threat neutralized and said there is nothing to fear from the defendant’s three alleged accomplices.

The terror scheme “has been broken up,’’ said Police Commissioner Raymond Kelly. “I see no danger emanating . . . from the people involved in this investigation.”

He would not elaborate, and police and federal investigators have repeatedly refused to discuss the whereabouts of the three people who are alleged to have helped Afghan immigrant Najibullah Zazi buy beauty supplies for use in brewing up explosives.

Police also said there are no extra security measures in place in subways or elsewhere in New York because of the alleged plot.

The FBI was listening in and becoming increasingly concerned as the anniversary of the Sept. 11, 2001, attacks and a New York visit by President Barack Obama approached, officials said. On Sept. 10, investigators secretly searched Zazi’s rented vehicle in New York and found a laptop computer with bomb-making instructions, authorities said.

First of all, they TOWED the THING from in front of the house, and secondly, they stopped him at a "routine drug check" and let him proceed into the city, and thirdly WHATEVER HAPPENED to those HANDWRITTEN NOTES, huh?

Zazi, fearing he was being watched, flew back to Denver on Sept. 12, authorities said. He was arrested a week later.

"SJC OK’s secret use of GPS devices; Rules set for police to plant tracking devices in suspect’s vehicle" by John R. Ellement, Globe Staff | September 18, 2009

For the first time, the Supreme Judicial Court ruled yesterday that the state constitution allows police to break into a suspect’s car to secretly install tracking devices using a global positioning system, provided that authorities have a warrant before they do so....

And you thought we were "liberal,' America!

The court said that using GPS devices as an investigative tool, which can require police to secretly break into a vehicle to install the device, does not violate the ban on unreasonable search and seizure in the state’s Declaration of Rights....

What's next, a phart chip??

The SJC said the devices can be installed for up to 15 days before police must show why the devices need to remain in place. Generally, search warrants expire after seven days. William Leahy, chief counsel for the Committee on Public Counsel Service, said the SJC clearly built a new wall of protection for individuals when it comes to government use of electronic monitoring devices.

They are actually calling this "protection?"


Leahy said the SJC ruling also means that police must persuade a judge they have probable cause before the GPS devices can be installed. He said that will be a barrier to widespread use by law enforcement. “It’s good for the public, and it’s good for the rule of law,’’ Leahy said. “I don’t think it is currently a frequent law enforcement tactic. But the important point now is that it is much less likely to become a frequent tactic.’’

Prosecutors agreed with Leahy and welcomed the SJC decision. They said the court spelled out what rules police must follow when they target a suspect, something that had been lacking.

“Police want to follow the rules,’’ said Berkshire District Attorney David Capeless, president of the Massachusetts District Attorneys Association. “They just want to know what the rules are and that they are clear. This is clear.’’

The tendency of government agencies to charge sky-high prices for public information came into play earlier this year when the Globe asked Boston officials for the e-mails of six city officials, and the city said it would cost $30,000....


Secretary of State William F. Galvin’s office, which is responsible for enforcing the public records law, said most complaints about violations are made by ordinary individuals with little hope of raising the money government agencies often charge.

Tom Fiedler, dean of the College of Communication at Boston University and a former executive editor at The Miami Herald, said reporters and citizens in Florida enjoy much broader access to government records than their counterparts in Massachusetts.


“What I have seen here strikes me as so contrary to my experience in Florida that I’m actually startled by it,’’ Fiedler said. “I don’t know why the citizens of Massachusetts tolerate it.’’

If sunshine is the best disinfectant, then Massachusetts is doomed to contagion without a dramatic reform of the public records laws.

Assistant US Attorney Jeffrey Cohen said federal prosecutors estimated that Modern Continental overbilled the federal government between $500,000 and $1 million. They estimated that faulty construction cost between $3 million and $8 million to repair.

But Michael Connolly, a lawyer for now-bankrupt Modern Continental, said that, for the most part, the concrete worked as it was supposed to. And while acknowledging that Modern Continental did overbill the government, he said the total was closer to $100,000....

Modern Continental was paid about $295 million for its work on the Big Dig project. Of that, about $49 million funded work on concrete walls that routinely flooded highway tunnels.

Woodlock criticized both lawyers for producing damage estimates that were not backed up by expert testimony, which made his sentencing decision difficult, if not impossible.

“I have a view that I have to make the best findings I can,’’ Woodlock said. “And this is back-of-the-envelope kind of stuff, as far as I can see.’’

Prosecutors had previously dropped criminal charges against Modern Continental in connection with the 2006 ceiling collapse that killed Milena Del Valle, 38, of Jamaica Plain.

HARTFORD - They used to call Connecticut “The Land of Steady Habits,’’ but lately it has been more like the land of steady handouts. One mayor received expensive wines and Oriental rugs. A governor scored a free hot tub and cathedral ceilings; his aide landed a stack of gold coins. And a state treasurer finagled . . . well, money.

They are just a few of the prominent city and state officials collared in corruption probes in recent years. But their downfalls, and resulting efforts to reform ethics rules, apparently have not stemmed the tide of charges against public servants. The latest to be arrested - for the second time - is Mayor Eddie A.Perez, for alleged extortion.

The spate of scandals is a source of chagrin for the state, and the sting of each new nickname - “Corrupticut,’’ “Louisiana with foliage’’ - worsens with each new corruption arrest and indictment.

“You got these guys doing unbelievably crazy stuff. One would think the politicians would realize that they’re going to get caught,’’ said state Representative Michael P. Lawlor, a former prosecutor who heads the Judiciary Committee. “At the end of the day it’s embarrassing.’’


No one is suggesting that the number of corruption cases in tiny Connecticut rivals those of New Jersey or Louisiana, or that the sheer audacity competes with Illinois.

Don't forget about Bay State.

Why has the Nutmeg State been such fertile ground for malfeasance? One factor often mentioned is Connecticut’s unusual combination of wealth and poverty: It has the third highest mean household income in the country, according to 2008 census data, but the cities where the most prominent scandals have occurred have some of the poorer neighborhoods.

The poor stealing from themselves, huh?

Another reason is a standard of ethics.... The state has no law that requires lobbyists to disclose their financial dealings with municipal authorities, said Tom Swan, executive director of Connecticut Citizen Action Group, a nonprofit advocacy organization.

The lax ethics and ensuing scandals have left voters “too numb to be very outraged’’ by the latest allegations, said Scott L. McLean, a professor of political science at Quinnipiac University. “The high-profile corruption cases in the state over the past few years have only confirmed their low opinion of politicians.’’

They are not helping themselves (except to your tax loot) wherever they are.

Some politicians are getting the message. The state has prohibited lobbyists from contributing to election campaigns, Lawlor said. Strict new rules allow state employees on official travel - and their family members - reimbursement only for essential expenses, which they have to report. Similarly strict rules now apply to gifts worth more than $10. “If someone gives us a plaque, we have to pay them or give it back,’’ Lawlor said.

Lawlor and other legislators also want to beef up the state’s powers of investigation. Rowland, Silvester, Newton, Ganim, and other prominent officials were brought down by federal investigations - a trend officials in Connecticut attribute, in part, to the high standards state prosecutors must meet to convene a grand jury and subpoena witnesses.

Many states, including Massachusetts, have a continuously sitting grand jury, to which prosecutors may begin presenting evidence as soon as they believe they have a case.

In Connecticut, prosecutors must persuade a panel of judges that a grand jury is necessary before one is convened, an obstacle that Chief State’s Attorney Kevin T. Kane said sets a high bar for the state to make its case in corruption probes.

“It does tend to hamstring us, very much so,’’ Kane said.

Proposals to make it easier for the state to investigate graft have stalled in the Legislature....

EAST THETFORD, Vt. - They came by the hundreds down from the hills, converging in a field by the Connecticut River shortly after sunrise, bleary-eyed from drives that had begun at 4 a.m. and earlier.

Not the Schmitts, though. The family, from Winchester, Mass., had arrived at 5 the night before and set up camp - with no regrets. "We got a dining room table and chairs!" said Christine Schmitt.

For some, Memorial Day weekend is spent beachside, or perhaps by the lake or atop a mountain. But for a certain set, a must-do activity for the kickstart of the summer is a good sale. And by most measures, a granddaddy of Memorial Day weekend sales in New England is the tent sale at the Vermont furniture-maker Pompanoosuc Mills.

The event is not for the faint of heart. To land an oak dresser or a walnut table takes cunning, speed, and split-second thinking. When an emcee gives the word and flaps are pushed back on open-air tents at 10 a.m., a tidal wave of humanity pulses forward, drawn as if by powerful magnets. Pause, even for a second, and your dream armoire will be gone, tapped by another seeker of slashed prices on hardwood furniture, price reductions that often run into the thousands of dollars.

There are inevitable comparisons to the "Running of the Brides," the semi-annual sale at Filene's Basement where brides-to-be make a dash for discount wedding gowns. Indeed, Filene's Basement officials have conferred with Pompanoosuc officials on crowd control. Here in Vermont, folks like to think of the tent sale, in a sprawling field ringed by green hills, as civilized competition - sport for devotees of hand-crafted furniture.

"There is an adrenaline rush at the start when you're like: 'Will I get what I want?' " said Sara Carpenter of Wakefield, Mass., who snagged a tall dresser, her 5-week-old baby pocketed in a Bjorn on her front. "But it's laid back. I felt like I was at one of my old Phish shows, hanging out in the parking lot."

Officials say there are occasional ugly incidents, but rarely, and they are quickly smoothed over. One time, two men got into an argument over barstools. The more aggressive customer went home with the barstools while the other licked his wounds, though not for long. Store officials made him a new set for the same price....

JERUSALEM - Israeli police used stun grenades yesterday to disperse Palestinian rioters at a volatile Jerusalem site holy to Jews and Muslims, police said.

The incident took place during a visit by a Jewish group to the compound in Jerusalem’s Old City known to Jews as the Temple Mount and to Muslims as the Noble Sanctuary. Deadly violence has erupted there in the past.

Shmuel Ben-Ruby, police spokesman, said some 150 Palestinians threw stones at the Jews visiting the site, which is open to non-Muslims at certain hours. Jews regularly visit the compound, and it was not clear what sparked the violence.

Police dispersed the Jerusalem rioters using stun grenades, and two police officers were slightly injured. Two protesters were also slightly hurt before police restored order, Ben-Ruby said. The incident ended without serious injuries.

Religious and nationalist sentiment connected with the site has made it a flash point for violence in the past. A visit in 2000 by Ariel Sharon, then an Israeli opposition leader, helped ignite violence that engulfed Israel and the Palestinian territories for several years.

A rabbi who taught at a Jewish day school in Brookline in the mid-1970s has been indicted by a Suffolk County grand jury on charges that he sexually assaulted two students three decades ago.

Rabbi Stanley Zusia Levitt, 63, of Philadelphia is expected to surrender to Suffolk County authorities Oct. 17, the date of his scheduled arraignment on four counts of indecent assault and battery on persons under 14. Prosecutors accuse Levitt of assaulting two preteen boys while he served as a teacher at the Maimonides School in Brookline. School officials could not be reached for comment.

One of his accusers who called the Globe yesterday said that Levitt visited him at Children’s Hospital in May 1975. The alleged victim, now 46, said he was Levitt’s student and about 11 years old when the incident occurred. He said he was recovering from a school accident in which he lost the tip of his finger. The accuser, who requested that his name be withheld, said Levitt visited him on the first night of his two-week hospitalization, and sexually assaulted him in his hospital room. Levitt faces a single count of indecent assault and battery for that incident.

“I want it to be known to protect other children,’’ the accuser said. The alleged victim said he has suffered from depression, stemming from the incident, for most of his adult life....

It was not clear yesterday whether Levitt was listed as a sex offender or continued to teach after leaving Maimonides or where he might have worked after leaving the state....


If Levitt remained in the state, he would probably not have faced prosecution, because the statute of limitations, which was recently extended from 15 to 27 years, would have expired.

Massachusetts is the SICKEST S***-HOLE in the NATION!!

The alleged incidents occurred more than 30 years ago. But the state has a provision in the statute that essentially stopped the clock when Levitt moved out of Massachusetts.

In Massachusetts, the other three counts against Levitt stem from a three-day visit another boy made to Levitt’s Chiswick Road home in 1975. Prosecutors accuse Levitt of assaulting the boy on three occasions.

“This was a betrayal of trust in the most awful sense,’’ Suffolk District Attorney Daniel F. Conley said in a statement yesterday. “The evidence suggests that Levitt abused a position of power, respect, and authority to engage in sexual behavior with boys who were too young to resist and too afraid to speak out.’’

Conley learned of the allegations against Levitt after the alleged victim in the Children’s Hospital case contacted authorities last September. An investigation followed that led to a grand jury hearing the case. Levitt was indicted Wednesday.

Scott Curtis, a lawyer in Boston representing Levitt, declined comment on the charges....

Levitt moved to the Philadelphia area in the 1980s.

Records from the First Judicial District of Pennsylvania show he was charged there with several similar offenses, including indecent assault, endangering the welfare of children, indecent exposure, and unlawful restraint. He was found not guilty of the exposure and restraint charges, but pleaded no contest, which carries the same weight as a conviction, to indecent assault and corrupting a minor and was sentenced to probation on both offenses.

NEW YORK - A team of prosecutors, counselors, and religious leaders announced a program yesterday to combat sexual abuse among members of the insular world of Brooklyn's ultra-Orthodox Jews.

The centerpiece of the outreach program, announced yesterday by District Attorney Charles Hynes and leaders from community-based organizations that serve Jewish communities, is a hot line that abuse victims can call and speak to a "culturally sensitive" social worker.

The establishment of the team, which will focus on child sex abuse, comes partly in response to a discussion on State Assemblyman Dov Hikind's radio show last summer. Nine sex offenders live in tents surrounding a makeshift fire pit in the trees behind a towering “no trespassing’’ sign, waiting out their probation sentences as they face numerous living restrictions under one of the nation’s toughest sex offender policies.

“It’s kind of like a mind-game, it’s like ‘Survivor,’ ’’ said William Hawkins, 34, adding that he was directed to the campsite two weeks ago after being released from prison for violating probation by failing to register as a sex offender in Georgia.

The muddy camp on the outskirts of prosperous Cobb County is an unintended consequence of Georgia law, which bans the state’s 16,000 sex offenders from living, working, or loitering within 1,000 feet of schools, churches, parks, and other spots where children gather.

It’s not the only place in Cobb County where offenders can live - there are hundreds of other sex offenders throughout the county living in compliance with the law. But Ahmed Holt, manager of the state’s sex offender administration unit, calls the camp a “last resort’’ for homeless offenders who can’t find another place to live that complies with the law.

He said probation officers direct them to the outpost if other options fail, such as transferring to another county or state or sending them to a relative’s place that meets the requirements. Homeless shelters and halfway houses are often not an option, he said, because of the restrictions that bar them from being near children.

And in Manning, S.C., a private school where an 11-year-old girl died shut down after the number of pupils who were out sick with similar symptoms reached nearly a third of the student body. “It just kind of snowballed,’’ said Kim Jordan, a teacher at Laurence Manning Academy, which closed Wednesday after Ashlie Pipkin died and the number of ill students hit 287. “We had several teachers out also.’’

“H1N1 is spreading widely throughout the US,’’ said Thomas Frieden, director of the federal Centers for Disease Control and Prevention in Atlanta. The CDC reported last week that at least 26 states are now reporting widespread flu activity, up from 21 a week earlier.

Even though some parts of the Southeast that started seeing a surge of cases first now seem to be showing a decline, that could be a temporary reprieve, Frieden said. And other parts of the country are probably just starting to feel the second wave. “Influenza is perhaps the most unpredictable of all infectious diseases,’’ Frieden said.

Instead, that number represented one of several scenarios government agencies could use in planning for a resurgent wave of swine flu. The truth is that disease trackers cannot predict precisely how lethal any flu strain will turn out to be.

Timing is critical, too, and that’s especially true with swine flu: A vaccine isn’t expected to be widely available until mid-October, and the germ is already circulating among a population with little natural protection against it. Even in a regular season, chronicling the death toll from flu is notoriously tricky. Flu symptoms mimic other ailments, office tests are hardly foolproof, and the virus proves most lethal to patients already burdened with chronic illnesses.

“People die of heart attacks and pneumonias and so on who wouldn’t have died if they hadn’t been infected with influenza,’’ said Dr. David Ozonoff, a flu specialist at the Boston University School of Public Health. “But if you look at many of those death certificates, they won’t have influenza as the immediate cause or even the contributing cause.’’

Marc Lipsitch, a Harvard School of Public Health epidemiologist, speculated that the official count of swine flu deaths - it stands below 1,600, as of the middle of last week - “is certainly an underestimate of the number of deaths. It may be a bad underestimate or it may be a modest underestimate, but it is certainly an underestimate.’’

For example, research from New York City, particularly hard hit by the virus in the spring, showed that almost 20 percent of the people killed by swine flu hadn’t been hospitalized, Lipsitch said, making it less likely such deaths would be linked to the disease. Multiplied across the country, that phenomenon could contribute to making the flu strain appear less lethal than it is. Assessing swine flu’s impact was further muddied by a decision in the past month to change what counts as an H1N1 death....

So federal disease specialists expanded the definition to include deaths that doctors attribute to flu and pneumonia based on symptoms, and both the swine type and the seasonal strain count. Since that change was made, the count has grown....

Flu stands in stark contrast to other diseases that are far easier to monitor because they cause fewer cases with more distinctive symptoms. “With flu, we can have 60 million people potentially infected,’’ said Dr. Lyn Finelli, flu surveillance chief at the US Centers for Disease Control and Prevention. “We could never count all those cases, and we could never count all those deaths.’’

Harvard’s Lipsitch had a central role in developing the swine flu planning scenario authored by the President’s Council of Advisors on Science and Technology. That report - which said that in a “plausible scenario,’’ H1N1 could kill 30,000 to 90,000 - emphasizes “this is a planning scenario, not a prediction.’’

So WHEN does the scenario "GO LIVE," so to speak? Next week?

A cochairman of the council, Eric Lander, said it would have been irresponsible not to include dire scenarios. Failing to do so, he said, would be akin to neglecting the possibility that a coastal region could be walloped by the most powerful of hurricanes. “We’d better be prepared for a hurricane devastating New Orleans,’’ said Lander, director of the Broad Institute in Cambridge. “But that’s not the same thing as predicting a hurricane is going to devastate New Orleans.’’

To develop their models, the scientists reviewed what happened during the two most recent global flu epidemics, in 1957 and 1968. They examined the course of the H1N1 virus since it emerged in Mexico, traveled to the United States, and then hopscotched the globe. And they considered what might happen if infections are rampant before a vaccine is available.

But all of those considerations involve significant - if educated - guesswork. Consider even the widely cited figure that, in an average flu season, 36,000 people are killed by flu viruses in the United States.

It was distilled by federal specialists from more than two decades’ worth of flu surveillance.

Even the terminology is offensive.

Just because the CDC or some other agency puts out a number as an official health statistic, that doesn’t mean it’s a true and accurate number. It’s more of an estimate,’’ said Al Ozonoff of BU’s public health school, who specializes in the study of influenza.

A study released yesterday found that the federal government is prosecuting only about one out of four of those charged in connection with terrorism.

Since 2002, the percentage of terrorism cases federal prosecutors declined to pursue has grown from 31 percent to 73 percent, the study found. Nearly 6,000 of the close to 8,900 cases federal prosecutors referred for prosecution between 2004 and 2008 were closed without action....
